1. General information

1.1. The regulations of the Polny Wiatr online store, hereinafter referred to as the "Regulations", define the rules for using the online store, placing orders for Goods available in the online store, delivering the ordered goods to the Customer, paying the sales price of the Goods by the Customer, the Customer's right to withdraw from the contract and the rules for submitting and considering complaints. sklep.polny-wiatr.pl

1.2. Technical requirements

1.3. The Seller is not liable for any disruptions, including interruptions, in the operation of the Online Store caused by force majeure, unauthorized action of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.

The Customer is an adult natural person, a legal person or an organizational unit without legal personality, capable of performing legal transactions, who orders and purchases Goods in the Online Store, under the conditions specified in the Regulations, and the condition for placing orders and purchasing Goods by the Customer is that he/she has Website account.

The Online Store is a store run by the Seller in which orders are placed via the Website sklep.polny-wiatr.pl and the order is processed through the supplier.

Goods are products offered by the Seller in the Online Store, and the Seller conducts retail sales.

Sales agreement

Agreement for the sale of Goods within the meaning of the Civil Code, concluded between Biuro Inwestycyjny Progres Anna Bielska, Gągławki 6, 11-034 Stawiguda, Identification Number: 739- 247-54-91 , REGON: 280154329 sklep.polny-wiatr.pl and the Customer, concluded using the Store's website sklep.polny-wiatr.pl.

Order

The Customer's declaration of will, aimed directly at concluding a sales contract, specifying in particular the type and number of the Goods.

 

3. Rules of using the Online Store

The Customer may place orders in the Online Store provided that he/she registers first, i.e. completes the form, creates an Account and obtains his/her own login, as well as accepts the Privacy Policy and these Regulations, which are also available to the Customer before registration at sklep.polny-wiatr.pl. Obtaining a login. is possible already when placing the first order, during which the Customer has the opportunity to fill out the form. Then the Customer may suggest his own login, which, after registration, will be sent by the Seller with a password to the Customer's e-mail address.

The Polny Wiatr Online Store may deprive the Customer of the right to use the Online Store, and may also limit his access to part or all of the Online Store's resources, with immediate effect, when the customer:

· provided false, inaccurate or outdated data during registration in the Online Store, misleading the seller or violating the rights of third parties

· has committed an infringement of third parties via the Online Store, in particular the personal rights of other customers of the Online Store

· has committed other behaviors inconsistent with generally applicable provisions of law or general principles of using the Internet or detrimental to the good name of the Polny Wiatr Online Store.

A person who, for the reasons indicated above, has been deprived of the right to use the Online Store may not re-register without the prior consent of the Polny Wiatr Online Store, sklep.polny-wiatr.pl.

In order to ensure the security of the transmission of messages and data processed in connection with the services provided within the Online Store's website, we take the necessary technical and organizational measures appropriate to the level of threat to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.

 

4. Information about Goods

4.1. Information about the Goods available in the Online Store's assortment constitutes an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code.

4.2. Product prices indicated on the Online Store website: include VAT and are given in PLN.

4.3. The Seller reserves the right to make changes to the prices of goods on an ongoing basis and to conduct and cancel all types of promotional campaigns and sales. The right referred to in the previous sentence does not affect orders placed before the date of entry into force of the price change, terms of promotional campaigns or sales.

4.4. Goods by weight are subject to a tolerance during order completion of +/- 5% of the weight declared in the Customer's order.

 

5. Terms of order fulfillment

5.1. Orders from Customers are accepted by the Seller 7 days a week, 24 hours a day, on the Online Store website. sklep.polny-wiatr.pl.

5.2. Only adults can make purchases in the Online Store.

5.3. To place an order you must:

log in to the Online Store; sklep.polny-wiatr.pl.

· select the product that is the subject of the order and then click the "Add to cart" button

· choose the method of delivery of the goods

· enter the details of the order recipient and the address to which the goods are to be delivered

· enter the invoice details if they are different from the order collection details, if a VAT invoice is to be issued to the Customer;

· click the "Finish - place order" button;

· make payment for the ordered goods

5.4. Upon acceptance of the order on the website sklep.polny-wiatr.pl the Customer can choose the following payment methods for purchases, i.e.:

· cash on delivery of the order

· On-line - Payment card - Payments are handled via the Przelewy24 website, i.e. PayPro Spółka Akcyjna with its registered office in Poznań at ul. Kanclerska 15, 60-327 Poznań. NIP: 7792369887 REGON: 301345068.

· by payment card to the courier upon receipt of the order

5.5. If the execution of the order is possible, the Seller will send confirmation of acceptance of the order to the Customer's e-mail address indicated in his Online Account. The sales contract is concluded when the Customer receives an e-mail confirming the acceptance of the order for execution.

5.6. In the event of a shortage of the ordered Goods or when the ordered Goods are temporarily unavailable, the Seller:

· will inform the Customer about this fact to the e-mail address provided by him or by telephone to the number provided by the Customer.

· If the Customer does not consent to the execution of the Order in a different form (substitutes for the missing Goods), the Order will be canceled or, if the Customer consents, the Order will be reduced by the missing Goods.

 

6. Delivery of goods

6.1. Delivery of goods is carried out in the area:

Olsztyn, Dywity, Różnowo, Kieźliny, Stawiguda, Dorotowo, Bartążek, Jonkowo, Nikielkowo, Klewki, Tomaszkowo, Sząbruk, Unieszewo, Kudypy, Wadąg, Myki, Klebark Mały, Szczęsne, Stary Olsztyn, Naterki, Gronity, Łupstych, Słupy

Orders for delivery on a date other than the day of placing the order are processed up to six days in advance from Monday to Saturday inclusive.

6.3. Customers can access these Regulations at any time via the link on the home page sklep.polny-wiatr.pl.

The essential provisions of the Goods Sales Agreement are recorded, secured, made available and confirmed to the Customer by sending them to the Customer to the e-mail address provided by him in the Order and by attaching an order confirmation printout together with a VAT invoice or receipt to the shipment containing the Goods.

6.4. Delivery costs Olsztyn, Dywity:

· Shopping up to PLN 150 – cost of delivery - PLN 20

· Shopping over PLN 150 – free delivery

· Personal pickup, purchases from PLN 40, pickup in store

· Minimum order – PLN 200

· Shopping up to PLN 200 - 250 - cost of delivery - PLN 20

· Shopping over PLN 250 – free delivery

Orders are delivered in transport crates and packed in bags.

6.5. The goods are delivered to the customer's address indicated in the order form.

6.6. The ordered Goods are carefully packed in disposable packaging and delivered in special transport packaging delivered by a courier within Poland.

6.7. Orders are processed within the hours specified in the Delivery Regulations.

6.8. The Seller is not liable for non-delivery of the Goods or delay in the delivery of the ordered Goods and thus the execution of the order, resulting from force majeure, the absence of a person authorized to collect the order at the indicated address despite notification and an incorrect or inaccurate delivery address provided by the Customer and in the event of impossibility contacting the Customer at the provided e-mail address or telephone number.

6.9. A VAT invoice will be delivered together with the order if the Customer requests to receive an invoice by selecting the appropriate option in the order form. In other cases, the customer receives a receipt along with the delivery.

 

7. Terms of complaints and return of goods

The Polny Wiatr Online Store, as a seller, is liable to the Customer under the warranty for defects to the extent specified in the Civil Code, in particular in Art. 556 and art. 556[1]-556[3] et seq. of the Civil Code.

Complaints arising from violation of rights guaranteed by law or under these Regulations should be sent to: sklep.polny-wiatr.pl.

In the event of exercising warranty rights, if we deem it necessary to consider the complaint, you are obliged to return the defective goods.

All costs associated with returning the goods are borne by the Seller. The Seller undertakes to respond to each complaint immediately, no later than within 14 days from the date of its submission.

The customer has the opportunity to familiarize themselves with the delivered Goods before collecting them. The rules for handling Customer complaints are specified in the applicable provisions of the Civil Code (Article 556 et seq.) and other applicable legal provisions.

 

8. Out-of-court methods of dealing with complaints and pursuing claims

We would like to inform you that it is possible to use out-of-court methods of dealing with complaints and pursuing claims. Their use is voluntary and can only take place if both parties to the dispute agree to it.

The consumer may apply to the Trade Inspection to initiate proceedings for out-of-court resolution of consumer disputes regarding the concluded Sales Agreement, in accordance with Art. 36 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws 2001, No. 4, item 25, as amended).

The consumer may also request that a dispute regarding the concluded Sales Agreement be heard by a permanent arbitration court operating at the appropriate provincial inspectorate of the Trade Inspection, in accordance with Art. 37 of the Act of December 15, 2000 on Trade Inspection (Journal of Laws 2001, No. 4, item 25, as amended).

9. Withdrawal from the sales contract

9.1. The Customer may withdraw from the sales contract without giving a reason by submitting an appropriate written declaration to the Seller within 14 (fourteen) days from the date of completion of the order, i.e. from the date of delivery of the shipment to the Customer. To meet the deadline, it is sufficient to send a declaration of withdrawal from the contract, a template of which is provided to the Customer with the delivery. To exercise the right to withdraw from the contract, the Customer is obliged to inform about his decision to withdraw from this contract by means of an unambiguous statement (for example a letter sent by post or e-mail). In order to meet the deadline for withdrawal from the contract, it is sufficient for the Customer to send information regarding exercise his right to withdraw from the contract before the deadline for withdrawal expires. 9.2. The Customer is not entitled to withdraw from the contract in relation to contracts in which the subject of the service is:

· an item that deteriorates quickly or has a short shelf life; an item delivered in a sealed package which cannot be returned after opening the package for health protection or hygiene reasons if the package was opened after delivery.

9.3. If the Buyer withdraws from the contract, the Seller will, no later than 14 days from the date on which he was informed about the Buyer's decision to exercise the right to withdraw from the contract, refund the amount paid for the purchased goods, including the costs of delivering the goods (except for additional costs). resulting from the delivery method chosen by the Buyer other than the cheapest standard delivery method offered by the Seller).

The Customer is liable for any reduction in the value of the Goods resulting from using them in a manner that goes beyond what is necessary to establish their nature, characteristics and functioning. In the event of excessive wear of the item, the Seller will deduct an appropriate amount from the Customer, constituting the difference between the value of the new item and the returned item.

9.4. If the Buyer withdraws from the contract, the Seller will refund the money to the Buyer within 14 days. The Seller will make the refund in question in the same way as the original sales transaction was made or will make the refund in cash to the Buyer, unless the Buyer provides the Seller in writing with the bank account number to which the Seller is to refund the payment. When paying by card, the Seller always refunds the payment to the card.

11. Personal data protection

11.1. The Seller may collect information and data provided voluntarily by Customers, including:

· order entered in the forms

· registering an account in the Online Store

· data is saved on end devices (cookies)

11.2. The Seller may also save information about connection parameters such as IP addresses for technical purposes related to server administration and to collect general, statistical information or for security purposes.

11.3. Personal data collected by the Seller are processed in accordance with the provisions of generally applicable law. The administrator of the personal data collected in this way is the Seller.

11.4. Personal data is processed solely for the purpose of fulfilling the Customer's Order, providing electronic services, and sending commercial information to customers

11.5. The data may be made available to third parties providing certain services related to the execution of the Order, in particular delivery, payment, and customer satisfaction surveys in the Online Store.

11.6. The Seller undertakes to make every effort to protect the Customers' data provided to him. For this purpose, it uses technical measures required by law, including physical and organizational measures, ensuring protection of the processed data.

11.7. Each customer has the right to access their personal data, rectify it, delete it or limit processing. The customer has the right to object to further processing of his data, and if he consents to data processing, to withdraw it. Exercising the right to withdraw consent to data processing does not affect the processing that took place until the consent was withdrawn.

11.8. In connection with disclosed irregularities or violations in the processing of personal data by the Seller, the Customer has the right to lodge a complaint with the supervisory authority - the President of the Office for Personal Data Protection.

11.9. Customers' personal data will be stored for the period of operation of the Online Store.

 

12. Final provisions

12.1. The settlement of any disputes arising between Polny Wiatr and the Customer who is a Consumer will be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

12.2. The settlement of any disputes arising between Polny Wiatr and a Customer who is not a Consumer will be submitted to the court having jurisdiction over our registered office.

12.3. In matters not regulated in these Regulations, the provisions of applicable law shall apply, in particular the provisions of the Act of April 23, 1964. Civil Code (uniform text: Journal of Laws of 2014, item 121, as amended) and the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827). In the event of any conflicts between these Regulations and the consumer's rights and provisions arising from generally applicable provisions, generally applicable provisions of Polish law shall apply.

12.4. Contracts concluded via the Online Store are concluded in Polish.

12.5. The Seller reserves the right to make changes to the Regulations for important reasons, i.e. changes in legal provisions, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations. The Seller will inform the Customer about each change at least 7 days in advance.
